Translation of Imam An-Nawawi's Forty Hadiths
HADITH 33 : The plaintiff and the defendant

On the authority of Ibn Abbas that the Messenger of Allah said:
"Were people to be given in accordance with their claim, men would claim the fortunes and lives of [other] people, but the onus of proof is on the claimant, and the taking of an oath is incumbent upon him who denies."

Hadiths 33
selon Ibn Abbâs (que Dieu soit satisfait de lui) le Prophète (à lui bénédiction et salut), a dit:
« Si l`on accordait aux plaideurs, l`objet de leurs demandes, certes, on en verrait qui réclameraient les richesses et le sang d`autres gens. Mais il appartient au demandeur de faire la preuve et le serment est déféré a celui qui nie ».
